When I started my (recently closed) home remodeling business 43 yrs ago, a great majority of the work I did was done with handshakes instead of signatures, but as time went by it was clear that written words and signatures were needed to avoid any confusion or conflicts in understanding about scope of work. Essentially, it meant if we say we’re going to do something we’ll do it-if we don’t specifically say we are going to do something, don’t expect or assume it is included in the contract. Words have meaning. Speaking directly out of my legal ass, I doubt the lawsuit will be upheld in its present form. Maybe the track will be leveraged into certain concessions of some sort, but I doubt they’ll be forced to stop operations. If the time frame for the legal process to pan out regarding that shopping mall up the road is any indication of the potential glacier-like crawl of court actions, it might take years for the Laguna litigation to be finalized. Just a poor carpenter’s take……
