[Ducati] Dent in frame tube

The bike in question has a nickle sized dent in the upper tube by the 
steering head, it looks like the fork wacked it in a get off. The bike rides 
fine, it doesn't pull one way or another, etc. There are no cracks in the 
welds anywhere.

The reason I ask is there is a frame for sale on eBay that has a similar 
dent in it and the seller says it absolutely cannot be used on the road. 
However, the frame lives in England. Do they have some kind of law about 
that? It is a salvage frame.

Does a dent in a frame tube automatically mean that the frame is ruined? I 
wouldn't think so.
