[Ducati] 1000 DS SS Lower Fairings Burnt!

My 1000 SS now has 500 miles on it. Unfortunately, the other day I noticed
the lower fairings were making contact with the exhaust no both sides
creating burn marks and burn through on both sides. It almost seems like the
whole fairing is out of whack.  Has anybody else had this problem and most
importantly has anybody gotten Ducati to pay for new lower fairings under
warranty? Mine is under warranty until October of this year.
 
What is the ultimate solution to this problem. It looks like a real design
flaw to me.
